Tempo Privacy Policy

This is a preliminary policy. It will be reviewed by legal counsel before Tempo processes real transactions.

1. Who We Are

This Privacy Policy explains how Tempo Watches, LLC, a California limited liability company ("Tempo," "we," "us," or "our"), collects, uses, and shares personal information when you use tempo-watches.com and related services (the "Platform"). This policy is incorporated into our Terms of Service. If you do not agree with this policy, do not use the Platform.

2. Information We Collect

Information you provide:

  • Account information: name, email address, username, and credentials (managed through our authentication provider, Clerk).
  • Profile information: display name, bio, location, and other details you add.
  • Identity verification information: to sell on Tempo, and to buy at or above a transaction threshold (currently $2,500), you must complete identity verification through Stripe Identity. This involves submitting images of a government-issued photo ID and a live selfie. Stripe performs the verification, which may include biometric comparison of your selfie to your ID photo and related fraud detection. Tempo receives the verification result and limited extracted information (such as your verified name and document status); the underlying images and biometric data are processed and retained by Stripe under Stripe's privacy policy.
  • Transaction information: shipping addresses, purchase and sale history, offer history, and payout details. Payments are processed by Stripe; Tempo does not store full payment card numbers or bank account credentials on its servers.
  • Listing information: watch details, photographs, descriptions, pricing, and provenance information you provide.
  • Communications: messages between buyers and sellers on the Platform, dispute submissions and supporting evidence (including photographs), and communications with support.
  • Collection data: watches you add to your collection or watchlist.

Information collected automatically: device and browser type, IP address, approximate location derived from IP, pages visited, referral source, and usage patterns, collected through cookies and similar technologies and through our hosting and analytics providers.

Information from third parties: verification results and risk signals from Stripe; authentication outcomes from third-party watch authentication partners in connection with a dispute; and publicly available information about watches (not people) used to build our reference catalog.

3. How We Use Information

We use personal information to: operate the marketplace (listings, checkout, escrow, payouts, shipping coordination); verify identities and prevent fraud, counterfeiting, and abuse; adjudicate disputes between buyers and sellers, including reviewing submitted evidence; provide customer support; send transactional and account communications; send marketing communications you can opt out of; analyze and improve the Platform; personalize content and recommendations (including AI-assisted features such as the Tempo Advisor); comply with legal obligations (including tax reporting); and protect the rights, safety, and property of Tempo and its users.

4. How We Share Information

We do not sell your personal information. We share it only:

  • With other users, as needed to run a marketplace: your display name, profile information, and listing content are visible to other users; when a sale completes, the buyer's name and shipping address are shared with the seller solely to fulfill the order, and sellers are contractually bound (Seller Agreement §9.1) to use that information only for fulfillment.
  • With service providers who process data on our behalf: Stripe (payments, payouts, identity verification), Clerk (authentication), Supabase (database and storage), Vercel (hosting), Resend (transactional email), Sanity (content management), Inngest (background processing), and analytics providers.
  • With watch authentication partners, limited to the information needed to authenticate a specific watch in a dispute.
  • In a business transfer (merger, acquisition, financing, or sale of assets), where information may be disclosed to counterparties and transferred to a successor.
  • For legal reasons: to comply with law or legal process, enforce our terms, prevent fraud, or protect the rights and safety of Tempo, our users, or the public.

5. Cookies and Tracking

We use cookies and similar technologies for session management, preferences, security, and usage analytics. You can control cookies through your browser settings, though some Platform features may not function without them. Our Platform does not currently respond to "Do Not Track" browser signals.

6. Data Retention

We retain personal information for as long as your account is active and as needed for the purposes above, and thereafter as required for legal, tax, accounting, dispute-resolution, and fraud-prevention purposes. Transaction records are retained as required by law. Identity verification images and biometric data are retained by Stripe under Stripe's retention policies, not by Tempo.

7. Security

We use technical and organizational measures appropriate to the sensitivity of the data, including encryption in transit, access controls, and reliance on SOC 2-audited infrastructure providers. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

8. Your Rights and Choices

You may access and update your profile information in account settings. You may request access to, correction of, deletion of, or a copy of your personal data by emailing admin@tempo-watches.com. We may need to verify your identity before acting on a request, and we may retain information where required by law (for example, completed transaction records).

You can opt out of marketing emails via the unsubscribe link in any marketing message; transactional emails (orders, escrow status, disputes, security) will continue while you have an account.

9. California Privacy Rights

If you are a California resident, you may have rights under the California Consumer Privacy Act as amended (CCPA/CPRA), including the rights to know, access, correct, delete, and port your personal information, the right to opt out of "sale" or "sharing" of personal information, the right to limit use of sensitive personal information, and the right to non-discrimination for exercising these rights. Tempo does not sell or share personal information as those terms are defined under California law, and uses sensitive personal information (such as identity-verification data) only for the purposes permitted under the statute (verification, security, and fraud prevention). To exercise rights, contact admin@tempo-watches.com. An authorized agent may submit a request on your behalf with signed written permission.

10. Children

The Platform is intended for users 18 and older. We do not knowingly collect personal information from anyone under 18, and we will delete such information promptly if we learn of it.

11. Processing in the United States

The Platform is operated from the United States and is offered to U.S. users only at this time. Your information is processed and stored in the United States.

12. Changes to This Policy

We may update this policy. We will post the updated version with a revised "Last updated" date and, for material changes, provide notice by email or prominent notice on the Platform.
